Welcome to Happy Fox! The terms “we”, “us” and “our” refer to Happy Fox. Happy Fox operates this store and website, including all related information, content, features, tools, products, and services (the “Services”). Happy Fox is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”) and any policies referenced herein describe your rights and responsibilities when using our Services. Please read them carefully, as they include important legal information such as warranty disclaimers and limitations of liability.

By using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of majority in your province and have authorized any minor dependents to use the Services on devices you own or manage.

To use the Services, you may need to provide information such as email, billing, shipping, and payment details. You represent that all information provided is accurate, current, and complete, and that you have the rights to provide it.

You are responsible for your account credentials and all account activity. Accounts may not be transferred, sold, or assigned to others.

We make every effort to accurately represent our products online. Colors or appearance may vary due to your device or settings.

Product descriptions may change without notice. We may limit quantities or discontinue products at our discretion.

Placing an order is an offer to purchase. Happy Fox reserves the right to accept or decline orders. Your order is not accepted until we confirm it and receive payment. Review orders carefully before submission.

Purchases are subject to our Refund Policy. Orders must be for personal or household use, not for resale or export.

SECTION 4 - PRICES AND BILLING

Prices, promotions, and discounts may change without notice. Prices at checkout and in confirmation emails reflect current rates. Taxes, shipping, and handling are additional unless stated.

You agree to provide accurate and current billing information and promptly update it as needed. Credit card use represents authorization to charge the card for posted prices, shipping, and applicable taxes.

All prices are in CAD and subject to applicable taxes.

Payments are securely processed by Shopify Payments or other trusted third-party payment processors.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates only. We are not liable for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

However, if a package is lost or damaged during transit, please contact us and we will assist in filing a claim with the carrier.

SECTION 6 - INTELLECTUAL PROPERTY

All content and design on the Services are protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. Reproduction or unauthorized use is prohibited.

Trademarks, logos, product names, and slogans belong to Happy Fox or Shopify. Do not use them without permission.

SECTION 7 - OPTIONAL TOOLS

Third-party tools may be available. Use is at your own risk. We provide no warranties and are not liable for third-party tool use. Future tools and features are also governed by these Terms.

Our Services may contain third-party links. We are not responsible for content, policies, or transactions on external sites. Review third-party policies before engagement.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Sales are made directly with Happy Fox. Shopify provides the platform only. Shopify is not liable for your purchases or any related issues. You release Shopify from claims regarding your transactions.

SECTION 10 - PRIVACY POLICY

Our Privacy Policy applies to personal information. Some personal information (such as payment details or browsing behavior) is processed directly by Shopify in accordance with Shopify’s Privacy Policy. Submitted information may also be shared with Shopify and third parties in other countries to provide Services.

SECTION 11 - FEEDBACK

By submitting Feedback, you grant us a worldwide, royalty-free license to use it for any purpose. Feedback must not violate third-party rights or be malicious. We may remove Feedback at our discretion.

We do not alter or suppress genuine customer reviews and we do not offer incentives in exchange for positive reviews.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

We correct errors in content, pricing, promotions, and product information without notice. Orders may be updated or canceled if information is inaccurate.

SECTION 13 - PROHIBITED USES

You may only use the Services lawfully. Prohibited uses include illegal activity, harassment, transmitting malware, spamming, impersonation, or interfering with the Services. Violations may result in account suspension or termination.

SECTION 14 - TERMINATION

We may terminate access at any time. Sections on Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Privacy survive termination.

SECTION 15 - DISCLAIMER OF WARRANTIES

Services and products are provided “as is” and “as available” without warranties. We do not guarantee uninterrupted, secure, or error-free access. Some jurisdictions may limit disclaimer rights.

To the fullest extent permitted by law, Happy Fox, Shopify, and affiliates are not liable for direct, indirect, incidental, punitive, or consequential damages arising from your use of the Services or products.

You agree to indemnify Happy Fox, Shopify, and affiliates for claims arising from your breach of Terms, violations of laws or third-party rights, or use of Services.

If any provision is invalid, the remaining provisions remain enforceable.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

Failure to enforce any right is not a waiver. These Terms and posted policies constitute the entire agreement.

You may not assign rights without consent. We may assign or delegate our rights without notice.

SECTION 21 - GOVERNING LAW

These Terms are governed exclusively by the laws of Ontario and the federal laws of Canada applicable therein. You agree that any disputes shall be resolved in the courts located in Ontario, Canada.

Headings are for convenience and do not affect interpretation.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update Terms by posting changes on this page. Your continued use after updates constitutes acceptance.
